Post conviction relief is a form of motion practice, filed in the court of original jurisdiction, that seeks to overturn a conviction. This is different than "expungement" or "sealing." It is a process whereby the very integrity of a conviction is upended, necessitating a "do over" in the law. There are numerous bases for relief. The overturning of a conviction is called "vacatur" and if done properly, makes it as if the conviction legally never happened. When this occurs, the proper way, it clears the pathway for the immigration attorney by removing inadmissibility bars and even prior final orders of removal!
